Report Concerning the Trial Involving the Polish Club

We are pleased to provide this update concerning the lawsuit against the Polish Club, which proceeded to trial as scheduled in January of this year before the Honorable Alex Saldamando of the San Francisco Superior Court. We are very happy with the judge’s decision, which is posted on the website of the San Francisco Superior Court as well as on the Polish Club’s website. This summarizes some of the court’s most important findings.


The Court Ruled that it was Illegal For Mr. Zerucha To Vote Twice


The court concluded that the vote by which Mssrs. Lewandowski and Zerucha purportedly obtained control of the St. Stanislaus organization was "illegal," and that the arguments used to try to defend that vote were "illogical." The court ruled, in accordance with the law and common sense, that Mr. Zerucha could not vote twice in the September 2002 election. The judge has ordered a re-vote at a special meeting at which all legitimate members of the St. Stanislaus Benevolent Society will be allowed to participate. The judge noted not only was the vote wrong because Mr. Zerucha illegally voted twice, but that, in addition, Mr. Ozog of the PRCUA did not allow legitimate members of the St. Stanislaus group to vote or participate, further tainting the entire meeting that was held in September 2002. A hearing to determine the agenda for a special St. Stanislaus meeting is scheduled at the courthouse for August 6, 2004. We are confident that the special meeting will be scheduled soon after that, that a legitimate vote will be had, and a fair result obtained.


The Court Ruled In Favor of Waldemar Glodek On All Claims


The lawsuit against the Polish Club and its directors, which was signed under penalty of perjury by Mr. Lewandowski and Mr. Zerucha, made serious, but completely false, accusations against Polish Club president Waldemar Glodek. There was no evidence presented at trial to support the allegations. On the contrary, many witnesses testified about Waldemar Glodek’s wonderful and selfless volunteer work on behalf of the Polish Club. The judge ruled in favor of Mr. Glodek with respect to each and every one of the ridiculous charges brought against him.


Moving Forward With Polish Club Business


Most people know that litigation is expensive. Both before and after the lawsuit was filed, we tried to interest the other side in resolving the matter without litigation. We were not able to do that. As a result, we had to defend ourselves. It is unfortunate that we had to spend money on legal fees to confirm that there was no good basis for the lawsuit, and that one person cannot vote twice.
We are looking forward to having this case behind us. Throughout this difficult time, the Board of Directors has appreciated the support of many in the Polish community, the continued leadership of Waldemar Glodek, and the assistance of many who have, as always, helped us to continue the work the Polish Club was founded to do in 1926. In the true spirit of Polonia, over the past year, in addition to continuing with our potlucks, cultural events, annual seasonal events such as the New Years party and annual harvest festival, we have also had many wonderful and inspiring events at the Polish Club, including the 140th
anniversary celebration of the PNA in early 2004, a Polish Scouting convention, and a celebration of the 60th anniversary of the Warsaw uprising which will be held on August 1, 2004.

The Polish Club thanks all who support its efforts and who stayed on our side when the time of challenge came upon us. We look forward to the future and to many more years of serving the Polish Community in the San Francisco Bay Area!
